These terms govern your use of WordPuzzleGenie (the "App"). By downloading, installing, or using the App, you agree to be bound by these terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction) to use the App. If you are using the App on behalf of a company, you represent that you have authority to bind that company.

2. Your account

If the app requires an account, you are responsible for keeping credentials secure. If you sign in, you are responsible for keeping your credentials confidential, and for all activity that happens under your account. Tell us immediately at info@omniadataanalytics.com if you suspect unauthorised access.

3. Licence to use the App

Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use WordPuzzleGenie on Apple-branded devices you own or control, solely for your own personal, non-commercial use.

4. Restrictions on use

You may not:

• Copy, modify, distribute, sell, lease, or reverse-engineer any part of the App, except to the extent applicable law expressly permits.
• Use the App in any way that violates law, infringes someone else's rights, or interferes with the App's operation.
• Use the App to send spam, malware, or content that is unlawful, harassing, defamatory, or sexually explicit involving minors.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Use any automated system (bots, scrapers) to access the App, except where we have explicitly authorised it.

5. Your content

You retain ownership of any content you create or upload using the App. By submitting content to the App, you grant us a worldwide, royalty-free licence to store, process, and display that content solely as required to provide the App to you. You are responsible for ensuring you have the rights to any content you submit.

6. In-app purchases and subscriptions

Some features may be available only through one-time purchases or recurring subscriptions billed through your Apple ID. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel subscriptions in your Apple ID settings. Refunds are handled by Apple per their policies.

7. Apple's Standard EULA

Unless we provide a custom EULA on the App Store listing, your use of the App is governed by Apple's Standard End User License Agreement in addition to these terms. To the extent of any conflict, Apple's EULA controls for matters it specifically addresses.

8. Updates and discontinuation

We may release updates that change, add, or remove features. We may also discontinue the App entirely. We will use reasonable efforts to give notice of material changes that affect paid features.

9. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including (without limitation) warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of liability

To the maximum extent permitted by law, in no event will we or our licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from your use of the App. Our total liability for any claim arising from these terms or the App will not exceed the greater of (a) the amount you paid us for the App in the 12 months before the claim arose, or (b) US$50.

Some jurisdictions do not allow limitation of incidental or consequential damages, so the above may not fully apply to you.

11. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these terms or your misuse of the App.

12. Termination

You may stop using the App at any time. We may suspend or terminate your access if you breach these terms or for any other reason on reasonable notice. Provisions that by their nature should survive termination (ownership, disclaimers, limits of liability, governing law) will survive.

13. Governing law and disputes

These terms are governed by the laws of USA, State of Arizona, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the courts located in the State of Arizona, except that either party may seek injunctive relief in any court of competent jurisdiction. If you are a consumer resident in the EU/UK, you may also have rights under your local law that cannot be limited by these terms.

14. Changes to these terms

We may update these terms from time to time. Material changes will be announced in the App or by email; continued use after the new terms take effect constitutes acceptance.
