Terms of Service

These Terms of Service (“Terms”) govern your use of WordPuzzleGenie (the “App”), provided by Omnia Data Analytics LLC (“we”, “us”, “our”). By downloading, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App you represent that you meet this requirement. The App carries an Apple App Store content rating of 9+, which describes the content the AI may surface (occasional historical violence, illness, or other mild educational themes); this rating is independent of the 13-year-old minimum-use age above. A parent or guardian must agree to these Terms on behalf of any user under the age of majority in their jurisdiction.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, for your personal, non-commercial use. This license is also subject to Apple’s standard Licensed Application End User License Agreement (the “Apple EULA”); where these Terms and the Apple EULA conflict, the Apple EULA controls for App functionality provided by Apple.

3. Acceptable use

You will not, and will not permit any third party to:

• Reverse-engineer, decompile, or attempt to extract source code from the App except to the extent applicable law permits;
• Submit themes or other content that is unlawful, hateful, harassing, sexually explicit, defamatory, infringing, or that depicts or solicits content involving minors;
• Use the App to violate the rights of any third party, including intellectual property and privacy rights;
• Resell, sublicense, or commercially distribute the App or the puzzles generated by it without our prior written permission;
• Use automated means (bots, scrapers) to access the App or to bypass rate limits or paywalls;
• Interfere with the integrity or operation of the App or the servers that power it.

4. User-submitted themes & AI-generated content

Themes you submit. When you supply a theme (whether by choosing a preset or typing your own), you grant us a worldwide, royalty-free, non-exclusive license to process that theme for the purpose of generating a puzzle for you and to operate the App. We may transmit your theme to our generative AI provider (currently Anthropic) for processing. You retain any rights you have in the theme itself; you confirm you have the right to submit it.

Puzzles the App generates. The crosswords, word searches, hangman puzzles, word unscrambles, clues, and other content the App produces in response to your theme (“Generated Content”) are produced by a generative AI model and have no human author. Subject to your compliance with these Terms, we grant you a perpetual, worldwide, royalty-free license to use Generated Content for your personal enjoyment, including printing it, sharing the share-image with friends and family, and using it in classrooms or other non-commercial settings. For any commercial use (publication, resale, advertising), please contact us first.

No warranty of accuracy. Generated Content is created by an AI model and may contain errors (misspellings, mis-categorisation, surprising clue interpretations). We do not guarantee accuracy and you should not rely on Generated Content for educational testing, medical, legal, or other purposes where correctness matters.

Moderation

We use automated content classification to review themes you submit. Themes that violate this policy may be rejected; we may also remove generated puzzles that are flagged on review. We do not share submitted themes with third parties for marketing.

Reporting objectionable content

If you encounter a generated puzzle you believe violates this policy, tap and hold the puzzle in your Library and select “Report this puzzle.” We review reports promptly and may remove content or restrict accounts that repeatedly violate this policy.

5. Subscriptions and in-app purchases

The App offers optional auto-renewing subscriptions to the “Premium” tier:

• Monthly Premium — US$4.99 per month.
• Annual Premium — US$29.99 per year, with a 1-week free trial for first-time subscribers.

Prices in other territories are shown at the point of purchase. All purchases are processed by Apple through your Apple ID; we do not see or store your payment details.

Auto-renewal. Subscriptions automatically renew unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours prior to the end of the period at the then-current rate for the same plan.

Free trial. If you start a free trial and do not cancel before it ends, you will be automatically charged for the first paid period. You can cancel anytime during the trial to avoid being charged.

Cancellation. Manage or cancel your subscription at any time in Settings > [your name] > Subscriptions on your Apple device, or at the Apple subscriptions page (https://apps.apple.com/account/subscriptions). Cancellation takes effect at the end of the current paid period; you continue to have Premium access until then.

Refunds. Refund requests are handled by Apple under their standard refund policy (https://support.apple.com/HT204084). We do not process refunds directly.

What Premium unlocks. Unlimited daily puzzle generations (free tier is capped at 5/day), unlimited hints per puzzle (free tier is 3/puzzle), creative-hint mode, removal of generation caps, and the ability to share and print finished puzzles. Specific features and free-tier limits may change; we will notify you of material changes.

6. Privacy

Our handling of your information is described in our Privacy Policy, which is incorporated into these Terms by reference.

7. Disclaimer of warranties

The App is provided “as is” and “as available,” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that the App will be error-free or that Generated Content will meet your expectations.

8. Limitation of liability

To the maximum extent permitted by law, Omnia Data Analytics LLC and its officers, members, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profit, or interruption of service. Our total cumulative liability to you for any claim arising out of or related to the App will not exceed the greater of US$50 or the amount you paid us for the App in the 12 months immediately preceding the claim.

9. Termination

You may stop using the App at any time. We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or if continued provision is impractical for legal, security, or business reasons. Provisions that by their nature should survive termination (including Disclaimer, Limitation of Liability, Governing Law, and ownership of Generated Content already produced) will survive.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Material changes will be highlighted on this page or notified in the App. Continued use of the App after the effective date of a change constitutes acceptance of the updated Terms.

11. Apple-specific terms

You and we acknowledge that:

• These Terms are between you and Omnia Data Analytics LLC only, not with Apple. We (not Apple) are solely responsible for the App and its content.
• Apple has no obligation to provide maintenance or support for the App.
• In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the App purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product-liability, regulatory, or consumer-protection claims.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws provisions. The federal and state courts located in Maricopa County, Arizona, have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App, except where applicable consumer-protection law gives you the right to bring a claim in your local courts.
